(3) A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their self-employed professional activity (§ 13 BGB, German Civil Code). A business is any natural or legal person or partnership with legal capacity that, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity (§ 14 BGB).
(4) Deviating terms of the customer do not apply unless we expressly agree to them in writing.
§ 2 Conclusion of contract
(1) The presentation of the products in the online shop is not a legally binding offer but an invitation to order.
(2) By clicking the “Order with obligation to pay” button, you place a binding order for the goods in the cart. Before submitting, you can check your entries at any time and correct them using your browser's back function or in the cart.
(3) Immediately after submitting, you will receive an automatic confirmation of receipt by email. This does not yet constitute acceptance of your offer. The purchase contract is concluded when we accept your order by an order confirmation by email or by shipping the goods, but at the latest with the request for payment. For payment via PayPal, the contract is concluded when PayPal confirms the payment instruction.
(4) The contract language is German. We store the contract text and send you the order details and these Terms by email. You can also view your past orders in your customer account, provided you have created one.
§ 3 Prices and shipping costs
(1) All prices are final prices and include statutory VAT.
(2) Shipping costs are charged additionally:
- Germany: 6.99 € per order, free shipping for orders of 100.00 € or more.
§ 4 Delivery
(1) We deliver within Germany only.
(2) Unless stated otherwise for the product, delivery time is 2–3 business days. For payment in advance, the period begins on the day after the payment order is issued; for all other payment methods, on the day after conclusion of the contract.
(3) Products marked “coming soon” cannot be ordered yet.
(4) Shipping is carried out by DHL.
§ 5 Payment
(1) You can choose between:
- PayPal – You are redirected to PayPal and pay there. PayPal's terms of use also apply.
- Prepayment by bank transfer – You receive our bank details with the order confirmation. The goods are shipped after receipt of payment.
(2) The purchase price is due immediately upon conclusion of the contract.
§ 6 Retention of title
The goods remain our property until paid in full.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal. For details, see our Notice on the Right of Withdrawal.
§ 8 Voluntary 30-day return
(1) In addition to the statutory right of withdrawal, we grant consumers a voluntary right of return of 30 days from receipt of the goods. The prerequisite is that the goods are returned unused, unsoldered, not installed and complete.
(2) The statutory right of withdrawal and your statutory warranty rights remain unaffected.
§ 9 Warranty
(1) The statutory rights regarding defects apply.
(2) Our products are electronic components for model building. They must be connected and operated according to the respective product description, in particular with regard to supply voltage, maximum current, series resistors and cooling. Damage resulting from installation or operation outside these specifications does not constitute a defect of the goods.
(3) The ignition outputs of our controllers are intended exclusively for electric igniters (e-igniters). When handling pyrotechnic articles, the statutory regulations and the manufacturers' instructions must be observed.
§ 10 Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act.
(2) In the event of slightly negligent breach of an essential contractual obligation – one whose fulfilment is a prerequisite for the proper performance of the contract and on whose observance you may regularly rely – our liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded.
§ 11 Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 12 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is Reutlingen.
(3) Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
